MOHAMMED J. (Delivering the Ruling): By a motion on notice dated 22/11/04, the defendant/applicant prays for the following reliefs.

1.An order of the court staying further proceedings in this suit pending the determination of the appeal filed by the applicant against the ruling of this court delivered on the 26th day of October, 2004.

2.And for such further orders as the honourable court may deem fit to make in the circumstances.

Arguing the motion, learned applicant’s counsel, Mr. Chris Ekemezie Esq. said the application is brought pursuant to Order 50 of the Federal High Court (Civil Procedure) Rules, 2000 and under the inherent jurisdiction of the court. Accompanying the application, learned counsel said is a 9 paragraph affidavit deposed to by Perpetual Okwara. Attached to the affidavit also learned counsel said, is exhibit A1 which is the notice of appeal to the Court of Appeal.
