Judgement

REGINA OBIAGELI NWODO, J.C.A. (Delivering the Leading Judgment): The Appellant as the Claimant in the lower Court commenced an action by himself through a Writ of Summons against the Respondent praying for the reliefs stated in the statement of claim at page 10 of the record of Appeal. The claim reads as follows:

"a. A declaration that the Purported retirement by the Defendant/Respondent of the Plaintiff/Claimant is wrongful because no adequate opportunity was given for fair hearing and a pending case can not justify this retirement because it contravene the provisions of Chapter IV the (Fundamental Human Rights) of Section 36 of the 1999 Constitution of the Federal Republic of Nigeria i.e. a right to fair hearing.

b. A declaration that the Defendant/Respondent reinstates the Plaintiff/Claimant unconditionally in alternative the Defendant/Respondent should adequately compensate the Plaintiff/Claimant for breach of employment contract which is pensionable and loss of careers prospects …
