UCHECHUKWU ONYEMENAM, JCA (DELIVERING THE LEAD JUDGMENT): This application arose as a result of the Ruling of this Court delivered on 29th June, 2016 in Motion No. CA/J/117M/2015 granting leave to the Respondent to file Notice of Appeal against the judgment of the National Industrial Court, delivered on 4th March, 2015 in suit No. NICN/JOS/27/13.
The Applicant by Motion on Notice dated and filed on 2nd November, 2016 and brought pursuant to Order 7 Rules 1 and 10 (1) and Order 20 Rules 2, 5 (1) and (2) of the Court of Appeal Rules, 2011; Section 15 of the Court of Appeal Act, 2010 (as amended); and Section 6(6)(a) of the 1999 Constitution of the Federal Republic of Nigeria and under the inherent jurisdiction of this Court, sought the following reliefs:
