Judgement

MOORE ASEIMO ABRAHAM ADUMEIN, J.C.A.(Delivering the Leading Judgment): The respondent was the claimant in Suit No. B/302/2008 instituted in the High Court of Edo State, holden at Benin City. In his 2nd amended statement of claim the respondent, as plaintiff claimed the following reliefs, weeded of their particulars:

(A) (i) AN ORDER on the 1st defendants to pay to the plaintiff the sum of N16,000,000.00 (sixteen million naira) only being professional fees and general damages due to the plaintiff as a result of the legal services rendered to the 1st defendants.

OR

(ii) AN ORDER of this Honourable Court on the 2nd defendants to deduct at source the sum of N16,000,000.00 (sixteen million naira) only being professional fees and damages or any amount of judgment debt in favour of the plaintiff from the sum of N83,435,550.83 (Eighty-three million four hundred and thirty five thousand five hundred and fifty naira eighty-three kobo) only or from any other amount that is due to the 1st defendants…
