AYOBODE OLUJIMI LOKULO-SODIPE, J.C.A. (Delivering the Leading Judgment): The Appellants (suing for themselves and representing chairmanship and councillorship candidates, except the PDP, who contested the August 7, 2010 L.G. Council Election in Imo State and any candidate dissenting) as claimants commenced the case that the instant appeal is about by an originating summons dated 28/7/2011 and filed on the same date seeking for the determination of the following questions:-

1. Whether by the Orders of Honourable Justice Goddy Anunihu dated 11/05/2010 and 18/05/2010 in Suit No: HOW/545/2009, the 3rd to 29th Defendants were qualified to be candidates for the purpose of contesting the Imo State Local Government Council Elections held on the 7th day of August 2010.
