Judgement

OSEJI JCA (Delivering the Lead Judgment): By an information filed by the respondent in this appeal, the appellant herein was charged with another accused person with the following offences to wit:

“Statement of offence:

Count 1: Conspiracy to commit felony, to wit kidnapping punishable under section 516 of the Criminal Code, Cap C.21, Vol 1, Laws of Delta State of Nigeria, 2006.

Particulars of offence:

Monday Asakpa (M) and Paul Koki Ejedegba (M) on or about 14 September 2010 at Warri Judicial Division conspired among yourselves to commit felony to wit: kidnapping.

Statement of offence: Count II:

Kidnapping punishable under section 364(2) of the Criminal Code, Cap C21, Vol. 1 Laws of Delta State of Nigeria, 2006.

Particulars of offence:

Monday Asakpa (M) and Paul Koki Edejegba (M) on or about 14 September 2010 at Warri in Warri Judicial Division unlawfully imprisoned one Ifeanyi Akukalia (M) against his will.

Statement of offence: Count III:

Demand with menaces punishable under section 406 …
