Judgement

FABIYI, JCA (Delivering the Lead Judgment): This is an appeal against the ruling handed out by Chidobem, J., sitting at the High Court of Justice, Enugu on 6th day of September, 1999. The background facts leading to the ruling are very crisp and revealing. A As contained in the respondent’s brief of argument, the appellant, about September 1995, transferred about US $108,000.00 to the London accounts of the complainants - Mr. Ndukwo Ogbujah and Sir O. O. Ikoro. He collected the local equivalent of same being ₦9,724,820 under an exchange agreement. The London accounts of the complainants were later frozen on the orders of Mr. Justice Simon Boldblatt as the money transferred by the appellant to those accounts was fraudulently obtained by him from one Mr. Jerald v. Skoff. The F.I.I.B. Lagos investigated the matter. The appellant agreed to refund the sum of ₦6,000.000 to the complainants over three months with effect from June, 1996.
