Were the appellants who were plaintiffs in the High Court entitled to bring this suit when they were not Trustees of the Apostolic Revelation Society, the 13th defendant in the suit and when they have not sued in a representative capacity? These are the questions the trial judge answered in the negative which the appellants are seeking we set aside and reinstate their suit which is against the defendants.
There is no doubt that the plaintiffs are senior members of the said church and have been with the church for years ranging between 39 and 69 years. Believing that the church affairs were being mismanaged and the financial affairs was clouded in secrecy they decided to institute this suit at the High Court seeking the following reliefs:
- A declaration that the actions and inactions of 1st to 12th Defendants are in breach of their fiduciary obligations towards the church.
- A declaration that the 4 regions created within the Greater Accra Region and not approved by the General…
