IBRAHIM ALI ANDENYANGTSO, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of the Federal Capital Territory Abuja, Coram: Hon. Justice O. A. Adeniyi, J., delivered on 31/1/2017 in Suit No. FCT/HC/M/2419/16: DR. DAVIS SUNDAY ADEOLA and MRS. ROSE ADEOLA (Plaintiffs) v. MR. CLEMENT ETUH (Defendant) in which the lower Court entered judgment against MR. CLEMENT ETUH. Dissatisfied with the judgment, the Defendant filed this appeal on 7/2/2017, containing 2 grounds. See pages 47—48 of the Record of Appeal, simply referred to as "the Record." The judgment appealed against is at pages 39—46 of the Record.

The Record was transmitted to this Court on the 10/4/2017; the Appellant's Brief of Argument, settled by Austin N. Mwana Esq. was filed on 20/10/2020. The Respondent's Brief of Argument, settled by Eloka J. Okoye Esq. was filed on 26/10/2020 but deemed properly filed and served on 17/2/2021.
