MOHAMMED MUSTAPHA, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of the Federal Capital. Territory, Abuja, Coram Ugochuckwu A. Ogakwu, J, (as he then was), of the 23rd July, 2009.

The accused was at the trial charged with a three count charge of:

COUNT 1:

That you, VICTOR EZEORAH (M) 27 years, of No. 28 Ogbo Avenue, Woliwo, Onitsha, on or about the 24th day of January, 2005 at about 9:00pm at night, at Garki Abuja, within the Abuja Judicial Division, did conspire with others still at large to commit a felony to wit Armed Robbery, and thereby committed an offence contrary to Section 97 of the Penal Code, and punishable under 298 of the same Law.

COUNT 2:

That you VICTOR EZEORA (M) 27 years, of No, 20 Ogbo Avenue, Woliwo, Onitsha on or about the 24th day of January 2005, at about 9:00pm at night, at Garki, Abuja within the Abuja Judicial Division with others still at large, did committed Armed Robbery against Mr. Ibidapo by robbing him of …
