KUDIRAT MOTONMORI OLATOKUNBO KEKERE-EKUN J.C.A. (Delivering the Leading Judgment): The Respondent as Plaintiff instituted an action at the High Court of Justice, Osun State, Ila-Orangun Judicial Division against the Appellants as defendants for the following reliefs:

1. Declaration that the Plaintiff is entitled to the Statutory/Customary Right of Occupancy to the parcel of land situate at Olugbode Village Ila-Orangun and bounded on the 1st side by Pillar No. 826P and Kwara State land; on the 2nd side by Pillar No. 815A and Kwara State land; on the 3rd side by Pillar No. S.P. 820 and Odun Akogba River; and on the 4th side by Pillar No. B22P and Oteu River/Bode Ogunyomi's land.

2. The sum of N20, 000.00 (twenty thousand Naira) being damages for trespass committed by the Defendants to the said parcel of land in December, 1988 which trespass still continues.
