Judgement

IBIYEYE, J.C.A.(Delivering the Leading Judgment): This is an appeal against the judgment of Adekola, J. (as he then was) of the Oyo State High Court of Justice, delivered on the 12th day of July, 1991.

The plaintiff and the defendants respectively filed and exchanged pleadings in the trial court in strict compliance with the rules of that court.

The plaintiffs sought the following reliefs against the defendants:

"(1) Declaration that the 2nd defendant's letter Ref. No. P.507/87 of 4th December, 1984, written at the instance of the 1st defendant, dismissing the plaintiff from the employment of the defendant is irregular, unlawful, null, void and unconstitutional.

(2) Declaration that the plaintiff is still in the employment of the defendants.

(3) An order directing the defendants to reinstate the plaintiff to his status as a Local Government worker without prejudice to entitlements and promotions which might have accrued to him during the period of his dismissal.
