TIJJANI ABUBAKAR, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Judgment of the Ikeja Division of the High Court of Lagos State delivered on the 14th day of February, 2012 by O. O. Oke (Mrs.) J. in suit No: LD/2746/99.

The Respondent in this appeal was an employee of the Appellant and was summarily dismissed on allegations of gross misconduct. Aggrieved by his dismissal, the Respondent instituted an action against the Appellant at the lower Court by a Writ of Summons and a Statement of Claim filed on the 20th day of September 1999 seeking the following reliefs:

I. An order of this Honorable Court declaring the purported dismissal of the plaintiff from the Defendant's employment as illegal, null and void as it grossly contravenes Clause 6 page 26 of the Employee Code of Conduct and Ethical standard guide lines of the defendant company and it also violates S.33 of the Constitution of the Federal Republic of Nigeria.
