Judgement

GALADIMA, J.C.A. (Delivering the Lead Ruling): Two different set of applications have been filed before this Court. In the first application dated and filed on 28/1/2000, the Applicant as the Respondent in the second application pray for:

(1) An order staying further proceedings in the appeal before this Honourable Court pending the hearing and determination of the appellant's appeal to the Supreme Court.

In the second application dated and filed on 2/2/2000, the 4th,5th and 6th Respondents seek for the following orders:

"(1) An order varying in terms set forth in the schedule hereto the interlocutory injunction granted by the Federal High Court on the 5th October, 1999, in favour of First City Merchant Bank against the 5th Defendant and 5 others, pending the determination of the appeal filed at the Supreme Court against the ruling of the Court of Appeal Lagos delivered by the Court of Appeal as per Oguntade, J.C.A on the 24th January, 2000.
