Judgement

NNAMANI, J.S.C. (Delivering The Leading Judgment):-In this suit which originated in the High Court of the Federal Capital Territory, ABUJA, the respondent as plaintiff sued the appellant as defendant claiming the following reliefs:

"(i) A declaration that the purported termination of his appointment as a principal quantity surveyor with the defendant vide letter reference no. PC. 187/90 dated 25th day of March, 1986 is null and void.

(ii) A declaration that as a public office holder he is entitled to remain in the defendant's employment until he attains the statutory retirement age of 60 years.

(iii) A declaration that he is still an officer of Federal Capital Development Authority Abuja and is entitled to his salaries as principal quantity surveyor, all the allowances and privileges attached to it from 25th day of March, 1987 until he attains the age of 60 years.
