FIDELIS UGWU V. THE STATE

TSAMMANI, J.S.C. (Delivering the Leading Judgment): The judgment the subject of this appealed was delivered by the Court of Appeal, Abuja Division, on the 29th day of May, 2020. By the said judgment, the Court of Appeal affirmed the conviction of the appellant along with two others by the Niger State High Court of Justice sitting in Minna delivered by A.L.B. Bwari, J on the 22/6/2018. The conviction of the appellant was consequent upon his arraignment on a one count charge which reads as follows:

“That you Jemilu Shehu, Fidelis Ugwu, Abubakar Yakubu on or about the 15th day of January, 2015 at F - Layout Area, by Yusuf Datti Road, Minna, Niger State, Minna within the jurisdiction of this honourable Court while armed with a gun and knife attacked one Arch.
