JUDGMENT

I. INTRODUCTION

[1]. My Lords, this is a second appeal arising from matrimonial proceedings that commenced at the District Court ‘B’, Koforidua, proceeded on appeal to the High Court, Koforidua, and now comes before this Court on further appeal.

[2]. The appeal is directed solely against that part of the judgment of the High Court, Koforidua, delivered on 6th June 2024, sitting as a first appellate court, which ordered that the provision shop and the three plots of land situate at Akwadum, Koforidua, be shared equally between the parties on the principle of equality is equity.

[3]. The Appellant, being dissatisfied with that determination, has invited this Court to set aside the judgment of the High Court and to substitute it with an order for unequal distribution of the matrimonial properties in the ratio of eighty per cent in her favour and twenty per cent in favour of the Respondent.
