JUDGMENT

ADJEI, J.

The Applicants filed an application to this Court to enforce their fundamental human rights under Articles 25, 33 and 296 of the Constitution of Ghana, 1992. The Applicants were admitted by the 1st Respondent into its school to undertake full time (day) Bachelor of Science in Business Administration. The Applicants were given provisional admission and were to register and resit Core Mathematics in West Africa Senior Secondary Certificate Examination (WASSCE) and pass within a year to enable them to meet the entry requirements of the 1st Respondent. Both of the Applicants sat for the paper and passed within a year and finally completed the course they started in the 2011/2012 academic year. According to the Respondents, they knew they were graduating in 2016 after having successfully completed the course on 19th March, 2016.

When the list of the graduating students were published, their names were conspicuously absent. Enquiry by them revealed that…
