JIMI OLUKAYODE BADA, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Judgment of the Adamawa State High Court, Yola, in SUIT NO: ADSY/64/2005 -ALLISON UZOHO V. FRESSY TRUST LTD and 2 OTHERS delivered on the 27th day of February, 2012 wherein Judgment was entered in favour of the Plaintiff/Respondent.
Briefly the facts of the case are that by a Writ of Summons dated and filed on the 21st day of October, 2005 Plaintiff claims against the Defendants jointly and severally as follows:-
"(a) The sum of (N500,000.00) Five Hundred Thousand Naira only being general damages for defamation in respect of the contents of a disclaimer bearing a picture of the Plaintiff dated 1/10/2005 which the Defendants published and circulated in Numan, Adamawa State sometime in October, 2005 of and concerning the Plaintiff in his business as a sales man and business man to wit:-
