HASSAN JCA (Delivering the Lead Judgment): This is an appeal against the ruling of the Federal High Court Abuja, in suit No. FHC/ABJ

CR/146/10, delivered on 27 February 2012.

The respondent herein, was the accused person at the trial court on a six-count amended charge dated and filed on 16 February 2011 of an offence contrary to sections 15(d) and 15(2)(b) of the Money Laundering Act (Amendment) 2002. Thereafter, on 24 March 2011, the accused/ applicant (respondent herein), filed a motion seeking to quash the amended charge for want of jurisdiction to adjudicate over same.

The trial court heard both parties, and in its ruling, quashed the amended six-count charge and discharged the accused/respondent.

In the notice of appeal dated 12 April 2012 and filed on 21 May 2012, there were five grounds of appeal with their particulars and reliefs sought. The respondent filed a notice of preliminary objection on 1 March 2013.
