<p><strong> JEGA JCA (Delivering the Lead Judgment): </strong> This is an appeal by the appellants against the ruling/order by Hon. Justice B. Onuorah J. of the Katsina State High Court sitting at Funtua, made on the 29th October, 1996.</p><p>The facts of this case as can be seen from the printed record before the court are as follows: vide a motion <em> ex parte </em> dated 21st day of June, 1996, the respondent applied to the learned trial Judge to commit the appellants and seven other persons alleged to be privies of one Alhaji Abashe Na Alhaji Bajimi to prison for contempt of court. The said Alhaji Abashe Na Alhaji Bajimi was the appellant in suit No. KDH/68A/84 before the Kaduna High Court while the respondent herein was the respondent in the said suit which was an appeal from the Funtua Upper Area Court which itself also entertained the matter on appeal from the trial Area Court Dandume in the former Funtua Local Government Area of Katsina State.
