Judgement

ABDULLAHI JCA (Delivering the Lead Judgment): This is an appeal against the judgement of Kwara State National/State House of Assembly Election Tribunal holding at Ilorin, delivered on 21 October 2011, dismissing the petition of the appellant. The judgement can be found at page 1183 of the volume 3 of the record of the lower tribunal. In the said judgement appealed against, the return of the 3rd respondent as the duly elected Senator for the Kwara Central SenatorialDistrict was upheld. The facts of the case as can be gathered from the proceedings of the lower tribunal are that: Elections into the National Assembly of the Federal Republic of Nigeria were conducted nationwide on 9 April 2011. The appellant was the candidate of the Congress for Progressive Change (CPC) and the 3rd respondent was the candidate of the Peoples’ Democratic Party (PDP). Other candidates contested the elections with the parties to this appeal.
