FOLASADE AYODEJI OJO, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the Ogun State High Court sitting in Otta Judicial Division in Suit No: HCT/361/2006 delivered on 7th of July, 2015.

The Respondent as Claimants vide a writ of summons filed on the 9th of July, 2012 sought the following reliefs against the Appellants as defendants:

1. An Order of perpetual injunction restraining the Defendants by themselves, servants, agents, assigns or privies from further dealing with the Claimants five Plots of Land, the subject matter of this suit and from committing any further act of trespasses or in any manner, whatsoever, disturbing the Claimants possession of the five Plots of land situate lying and being at No. 7,9,11,13 and 15 Olaniyonu Street Area Ope-Ilu, Agbado Railway Station, Ado-Odo Ota Local Government Area of Ogun State, Nigeria shown and more particularly described on Survey Plan Nos.
