(Delivering the Leading Judgment) This appeal interrogates the Judgement of the Sharia Court Appeal Sokoto State in Appeal No: SCA/SK/7/2016 delivered on the 7th Decernber, 2016 by Hon. Alh. Muhammadu Tambari Usman (Presiding Qadi), Hon, Alh Shuaibu Sodangi Achida (Qadi) and Hon. Alh. Dahiru A. Danjega (Qadi).

The Appellant was the defendant before the trial Lower Sharia Court Wamakko in Suit No: CV/106/2014 instituted by the Respondent seeking for the distribution the estate of her late grandfather by name Mallam Halilu.

The defendant denied the claim of the Plaintiff and submitted that the heirs to the Late Mallam Halilu that is Ige (deceaseds wife and Defendants/Appellants mother) and two daughters; Tumba (Plaintiff's/Respondents mother) and Jimma Ige distributed the estate to the heirs including the Appellant who got 2 farms and a house.
