JUDGMENT

AGBEVEY, J.

The Petitioner and the Respondent were married under the customary law on the 14th day of January 2011 and converted the said marriage to a marriage  under the Marriage Ordinance (Cap 127) (1951 Rev.) the following day, on the  15th day of January 2011. The Petition was filed on the 23rd day of November, 2015 seeking the dissolution of the marriage on the grounds that the marriage has broken down beyond reconciliation by reason of the Respondent having deserted the Petitioner since the 13th day of December, 2013. 

The Respondent filed an Answer on the 15th day of February, 2016 in which she denied the material particulars. She averred that she moved out of the matrimonial home in August, 2013 because the Petitioner spent little or no meaningful time with the Respondent in their home.

She further averred that the conduct of the Petitioner denied her of her right to companionship and conjugal intercourse with the Petitioner and that there was no longer trust, loyalty …
