OBADINA, JCA (Delivering the Lead Judgment): This is an appeal against the judgment of the Borno State High Court sitting in Maiduguri in its appellate jurisdiction. The appellant was the plaintiff, whilst the respondent was the defendant at the trial area court. In 1967, the appellant instituted an action claiming a farm land in suit No. 99/67 against the respondent at the Auno Area Court. At the end of the trial, judgment was entered in favour of the appellant against the respondent on the 6th of June, 1967. The respondent did not appeal against the said judgment. According to the appellant, there was another case suit No.157/67 allegedly instituted by the same appellant against the respondent in respect of the same farm land. At the end of the trial of the alleged suit; judgment was entered against the plaintiff/appellant and the title of the defendant/ respondent was confirmed. The said judgment was dated 9/20/67.
