UWA JCA (Delivering the Lead Judgment): The appeal is against the judgment of the Kwara State High Court, delivered on 27 January 2014, presided over by M. O. Adewara, J. (hereafter referred to as the trial court) in suit No: KWS/15/ 2009. At the trial court, the claimant (now respondent) claimed against the defendants (now appellants) as follows: “a.
