AGUBE JCA (Delivering the Lead Ruling): This is an application by way of motion on notice brought pursuant to Order 7, rules 1, 2, 5, 6 and 7 of the Court of Appeal Rules, 2011 and under the inherent jurisdiction of this honourable court - section 6(6)(a) of the Constitution of the Federal Republic of Nigeria, 1999. The motion prays for the following orders:

Extension of time within which to seek leave as party interested under section 243 of the Constitution of the Federal Republic of Nigeria, 1999 to appeal against the judgment of the lower court delivered on 31 July 2009 by Hon. Justice E.

Mohammed of the Kwara State High Court sitting at Ilorin.

Extension of time to appeal as an interested party pursuant to section 243 of the Constitution of the Federal Republic of Nigeria, 1999 against the judgment of the lower court. Leave of court to appeal as an interested party against the judgment of the lower court to determine the suit.
