STEPHEN JONAH ADAH, JCA (Delivering the Leading Judgment):Â This is an appeal against the decision of the High Court of Niger State in Suit No: NSHC/MN/199/2013, delivered on 23rd day of February, 2015, Coram: M.J. Evuti, J.
The Respondent in this appeal was the Plaintiff while the Appellant in this was the 2nd Defendant. The reliefs claimed at the lower court by the respondent against the appellant and one other, jointly and severally are:
1. The sum of One Hundred Million Naira (N100,000,000.00) only as damages for Defamation/Libel.
2. An order compelling the defendants to publish a retraction of the allegations, and a public apology to him in the Guardian Newspapers, with equal prominence as the offending publication.
3. An order of substantial cost against the defendants.
Pleadings were filed and exchanged by the parties before the lower court. The lower court at the end of the trial, entered judgment in favour of the Plaintiff who is the respondent in this appeal.
