ELFRIEDA OLUWAYEMISI WILLIAMS-DAWODU, J.C.A.(Delivering the Leading Judgment): This appeal is against the Judgment of the Plateau State High Court delivered on December 15th, 2010 by Hon. Justice L. C. Dakyem, in the main that the Court failed to make a declaratory order setting aside the distribution of the Appellant's (Plaintiff at the Court below) cows by the Chief Magistrate Court, having failed to find ownership of the same in the Appellant.

From the printed Record before this Court, the gist of this appeal is as follows:

The Appellant's father, one Chungwom Gwott, gave his cows, thirty-seven (37) in number and fifteen (15) sheep to one Ibrahim Manu, a Fulani Cattle rearer at Fan in B/Ladi L.G.A. to rear for him sometime in 1988. The Appellant's father continued to pay cattle tax as the owner and to check up on the cows until he took ill and could not continue doing that.
