MUSTAPHA JCA(Delivering the Lead Judgment): This is an appeal against the judgment of the High Court of the Federal Capital Territory Abuja, presided by Honourable Justice I.U. Bello, and delivered on 31 May 2007, dismissing a motion which sought to set aside an arbitral award; dissatisfied, the appellant appealed by a notice of appeal dated 24 August 2007; the notice contained four grounds as per page 141 of the record of proceedings.

Facts In Brief: The appellant took a burglary and house breaking insurance policy with the respondent, see page 21 of the record; the insured premises of the appellant was robbed by armed men on 3April 2004, who made away with property valued at N10, 092,000.00 (ten million, ninety-two thousand naira), the fact of which was communicated to the respondent by a letter on 6 April 2004, see pages 34-36 and 67 of the record of proceedings.
