(Delivering the Leading Judgment): This appeal arose from the Judgment of the National/State Houses of Assembly Election Petition Tribunal holden in Gombe delivered on the 27th October, 2015 by which Judgment the Tribunal dismissed the Petition brought before it as Election Petition No. EPT/GMB/HA/18/2015.

Shuaibu Adamu Haruna, the 1st appellant, the candidate sponsored by the 2nd appellant, the APC, contested elections into Gombe State Houses of Assembly for Kwami. Four other candidates contested the election for the same position along with the 1st Appellant, namely Ahmed Abubakar who contested the Election on the platform of the Peoples Democratic Party; Abdulhamid Mahadi of the ADC, Hon. Bashir Ibrahim of the NNPP and Usman Muhammed Lado of the SDP.
