WAMBAI JCA (Delivering the Lead Judgment): This appeal is against the judgment of the Kaduna State High Court of justice delivered on 28 October 2010 by Honourable Justice James Abiriyi.
The appellants who were the plaintiffs at the lower court claimed against the respondents who were the defendants at the lower court jointly and/or severally the following reliefs:
“1. A declaration by the courts that the title to land of plots No. 1a, Tradefair Complex No. NC20523 (Certificate of Occupancy) given or issued in favour of Pindar Lawal Garba by the Government of Kaduna State, which by virtue of sale is and does belong to Alhaji Nuhu Haruna (by virtue of deed of assignment - made on 15 October 1993).
2. A further declaration that by virtue of the deed of assignment, all interest and right inherent to the said deed reside in Alhaji Nuhu Haruna.
