Judgement

MASSOUD ABDULRAHMAN OREDOLA, J. C. A. (Delivering the leading judgment): On the 14th day of April, 2007 election to the office of member of the State House of Assembly representing Sokoto South 1 Constituency was organized and conducted by the 2nd, 3rd and 4th Respondents. Ibrahim Dasuki Haske, the Appellant herein contested the said election on the platform of the Democratic Peoples Party (hereinafter called DPP), while the 1st Respondent, Mohammed Bello Magaji did the same on the platform of the 5th Respondent, Peoples Democratic Party (hereinafter called PDP).

Upon declaration of results, the 2nd and 3rd Respondents returned the 1st Respondent as the duly elected member to the afore described office having scored 20,707 votes as against 7,035 votes scored by the Appellant.

Being dissatisfied with the result of the election, the Appellant filed a petition on 15th May, 2007 challenging the declaration and return of the 1st Respondent on four grounds, namely:
