JOSEPH TINE TUR, JCA (Delivering the Leading Judgment): On the 7th day of May, 2012, Onjefu, Esq. of the Economic and Financial Crimes Commission, Abuja sought and was granted leave by Umar, J., of High Court No.12 of the Federal Capital Territory, Abuja to arraign (1) Hon. Iorwase Herman Hembe, Chairman, (2) Honourable Azubogu Chris Emeka Ifeanyi, Deputy, all of the House of Representatives Committee on Capital Market on two separate counts under Section 308 and punishable under Section 309 of the Penal Code Act, Laws of the Federation of Nigeria (Abuja) 1990, their offences being that each collected air tickets and the sums of $4095 (Four thousand, Ninety Five Dollars) from the Securities and Exchange Commission as estacode to attend a conference in PUNCTA CANA, the Dominican Republic, titled "Emerging Markets Conference" but both did not attend, and neither would they refund the estacode to the Securities and Exchange Commission.
