MUDASHIRU NASIRU ONIYANGI, J.C.A. (Delivering the Leading Judgment): This judgment is predicated on the appeal by Hi-Tech Construction Company Ltd., as Defendant against the judgment of High Court of Edo State sitting in Benin City in Suit No. HOR/53/2013 delivered on the 25th day of April, 2016 in favour of the Respondent, Patrick Onome Onomuaborigho before the trial Court in the following terms. (See page 202 of the record of appeal)
In the result, the claimants case succeeds in part. I hereby make the following orders:
(1) The sum of N20,000,000.00 (Twenty million Naira) is hereby awarded as general damages in favour of the claimant for the loss of the claimants left leg, physical, psychological and emotional pains suffered by the claimant as a result of the event of 22nd day of August,2010.
(2) The sum of N50,000.00 is awarded as cost in favour of the claimant.
