ONIYANGI JCA (Delivering the Lead Judgment): The High Court of Delta State sitting in Oleh Judicial Division and presided over by Hon. Justice (Dr.) F.O. Oho on 21 December 2011 delivered a considered judgment in a matter of Enforcement of Fundamental Human Rights as enshrined in sections 41 and 46 of the Constitution of the Federal Republic of Nigeria, 1999 and wherein the respondents sought for the following orders of the court: β(1) An order of injunction that the purported arrest anddetention of the applicants and the continuous harassment so that they will not be able to get assess to court to testify as witnesses in charge No. HCO/2C/2010, The State v. Joshua Uturu and 6 Ors, before the court No. 2 ward is unlawful, wrongful, unconstitutional and null and void.
