EKANEM JCA (Delivering the Lead Judgment): This appeal is against the judgment of the High Court of Lagos State, Lagos

Division (hereinafter referred to as “the trial court”) sitting at the Commercial Division in suit No. LD/421/2006 delivered on 25

April 2008. In the judgment, the trial court granted the appellant (qua claimant) its relief No. 1 which was declaratory in nature but dismissed the remainder of the reliefs, viz; reliefs 2 - 8.

Aggrieved by the decision, the appellant has appealed to this court by way of a notice of appeal dated and filed on 2 July 2008.

It is pertinent to state even in summary form, the facts of the case leading to this appeal. The appellant, a company registered under the laws of the Federal Republic of Nigeria, carries on the business, inter alia, of providing various categories of skilled and unskilled labourers etc., for service companies at the latter’s request.
