BODE RHODES-VIVOUR, J.C.A. (Delivering the Leading Judgment): By a Motion on Notice filed on the 22nd day of January, 2009 and brought under order 7 rule 10 (2) of the Court of Appeal Rules, Section 15 of the Court of Appeal Act, Cap. C 36, LFN. 2004 and the inherent jurisdiction of this Honourable Court the applicants seek the following:-
