Judgement

OMAGE, JCA (Delivering the Lead Ruling): In this application the defendant judgment debtor seeks an order of court to extend time to apply for a stay of execution the judgment of the High Court Oyo State delivered in Ibadan on 26th April, 2002; and for an order of this court to stay the execution of the said judgment of the said court. The application is supported by an affidavit on which the applicant relies. In the affidavit the applicant deposed that he had applied in the court below for a stay of execution which was dismissed by the court below, applicant now applies to this court for ; Extension of time to bring the application to this court.

(b) For an order of this court to stay the execution of the order of the court below to pay damages to the respondent of the sum of N50,000; to hand over to the respondent, the property situate and lying and being at Oluwo Village, Orita Bashorun Ibadan, and to restrain the enforcement of an order of injunction made against by the court belโ€ฆ
