MANGAJI, JCA (Delivering the Lead Judgment): This appeal is a further appeal from the decision of the High Court of Benue State, sitting in its appellate Jurisdiction, dated 26th May, 1994 Coram: Ikongbeh J. (as he then was) and Hwande J. in which the decision of the Gboko Area Court Grade 1, dated 21st
March, 1991 was affirmed. The decision of the Area Court Grade 1, Gboko was delivered in favour of the Respondent who, as Plaintiff, took the Appellant before the Court, claiming title to a piece of farm land the latter was allegedly said to have encroached upon. The Appellant was dissatisfied with the said decision of the Area Court Grade 1, Gboko, wherein he appealed to the High Court of Benue A
State. The Court affirmed the decision of the Area Court. Still dissatisfied, he now appealed to this Court, questioning the Judgment on six grounds of appeal after this Court, on 8th June, 1995, granted the Appellant extension of time by 8 days from that date within which to appeal.
