NDUKWE-ANYANWU J.C.A., (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Cross River State sitting in Akamkpa delivered on 7th day of July, 2009 in suit No.HK/1/2009. The Appellant as plaintiff took out a writ against the Respondents as defendants and claimed the following:</p><p> &quot;1.
