UGOCHUKWU ANTHONY OGAKWU, JCA (Delivering the Leading Judgment): This appeal is against the decision of the High Court of Lagos State in SUIT NO. ID/968M/2009: BARRISTER ERIC CHUKWUEMEKA IGWEOKOLO v. MR. MARVEL AKPOYIBO and ORS. delivered on 13th July 2010. In the said judgment which is at pages 274-281 of the Records, the Appellants application for the enforcement of his fundamental rights was dismissed. The Appellant being dissatisfied appealed against the said judgment. The Notice of Appeal is at pages 282-287 of the Records. The Respondents equally dissatisfied with the order of the lower Court for them to apologise in writing to the Appellant filed a cross appeal.
