Judgement

ONYEKACHI AJA OTISI, J.C.A. (Delivering the Leading Judgment): The Appellant as plaintiff filed an action before the High Court of Lagos State (the lower Court) claiming, inter alia, the sum of N100million for publication of the 2nd Respondent on 9/2/2001, alleged to be libelous, and alleged to have been authored and authorized by the 1st Respondent. The lower Court, Coram T.A.O. Oyekan-Abdullai, J., in its judgment delivered on 21/11/2008, dismissed the Appellant’s claim, holding that the words in issue, were not libelous but were words of facts and opinion said by the 1st Respondent and published by the 2nd Respondent, in good faith and in reasonable belief that the words were true.

Dissatisfied with the said judgment, the Appellant lodged this appeal by Notice of Appeal on four grounds of appeal, dated on 26/1/2009, pages 221-223 of the Record of Appeal, seeking to have the decision of the lower Court set aside, and judgment entered in Appellant’s favor.
