Judgement

OGUNMOYE J. (Delivering the Ruling): By a writ of summons and statement of claim dated 10 June 2016 and filed same day, the claimant claimed against the defendants jointly and severally as follows:

(a) A declaration that the claimants are entitled to the customary right of occupancy in respect of the entire land situate, lying and being at Ugbo-Odo measuring approximately two miles in breath and three miles in length and bounded by Iludun-Ekiti along Odo Awo/Agama stream through Omi Osokia and Ero River forming the boundary of Iye-Ekiti with Usi-Ekiti.

(b) Possession.

(c) An order of perpetual injunction restraining the defendants by themselves or through their agents , privies, representatives and/or servants from further entering, building, constructing, trespassing or interfering with the right of the claimants to the land situate, lying and being at Ugbo-Odo measuring approximately two miles in breath and three miles in length and bounded by Iludun-Ekiti along Odo Awo/ Agama strea…
