AKINTAN, JCA (Delivering the Lead Ruling): The applicant, Miss Adejumoke Odutola, is the eldest issue of Adegbenga Adedapo Odutola who died on 20th September 2000. The said Adegbenga Adedapo Odutola was one of the issues of late Chief Timothy Adeola Odutola and was also one of the executors and a beneficiary of his said late father, Chief Timothy Adeola Odutola’s Will. The Will was challenged in court in Suit No. AB/ 130/96 and Adegbenga Adedapo Odutola was one of the defendants in that suit. Judgment was delivered in the suit on 24th May, 2000 and the court nullified the will and codicil in its judgment and ordered that letters of administration be issued in place of the will and codicil. The 1st, 2nd and 4th defendants in the suit were dissatisfied with the judgment and they have appealed against it to this court. Adegbenga Adedapo Odutola, the father of the present applicant, was named as the 13th respondent in the said appeal now pending in this court.
