SAIDU TANKO HUSSAINI, JCA (DELIVERING THE LEADING JUDGMENT): The appellant commenced action as plaintiff in the name of the Incorporated Trustees of the Brotherhood of the Cross and Star, at the High Court of Justice of Borno State vide the writ of summons and the statement of claim dated the 27th day of January, 2002. The claim is for (a) A declaration that the defendant jointly and severally have ceased to be members of Brotherhood of the Cross and Star haven (sic) been expelled and excommunicated by the plaintiff (b) An order of perpetual injunction restraining the defendants jointly and severally by themselves, agents and privies from further parading themselves as officials and/or members of the Brotherhood of the Cross and Star (c) An Order of Perpetual injunction restraining the defendants by themselves, agents and privies from entering into dealing or interfering with any of the landed properties of the plaintiff either acquired on lease or owned by them anywhere within the ju…
