SAIDU TANKO HUSSAINI, JCA (DELIVERING THE LEADING JUDGMENT): The appellant commenced action as plaintiff in the name of the Incorporated Trustees of the Brotherhood of the Cross and Star, at the High Court of Justice of Borno State vide the writ of summons and the statement of claim dated the 27th day of January, 2002.
