UWA JCA (Delivering the Lead Judgment): The respondent was the claimant at the trial court. He was a former employee of the appellant (then defendant) as a van sales representative. The respondent voluntarily resigned from his employment with the appellant, which was accepted following which he was paid his terminal benefit and the respondent commended his diligent service. It was said that the appellant had worked for two other tobacco companies before joining the appellant. Consequently upon the respondent’s resignation, the appellant put up an advertisement/disclaimer notice in the newspaper to inform the public that the respondent had left the appellant’s employment and was no longer representing the appellant’s company. The respondent was unhappy with the publication and took action in the lower court for defamation of his character.
