INTERCITY BANK PLC V. FAISAL TRAVEL AGENCY LIMITED

STANLEY SHENKO ALAGOA, J.C.A. (Delivering Leading Judgment): This is an appeal against the Judgment of M.U. Alkali J. of the Kano State High Court, which was delivered on the 27th July, 2001 in suit No. K/517/200 between Faisal Travel Agency Ltd V. Intercity Bank Plc ,wherein the learned trial Judge entered Judgment in favour of the Respondent, against the Appellant in the sum of N=2,192,000 (Two million, One hundred and ninety two thousand naira only), plus interest at 21% on the said sum from 14th April, 1997, until 27th July, 2001 and thereafter at 10%, until judgment sum is fully liquidated. The writ of Summons was filed under the undefended list procedure. The Particulars of Claim and the affidavit in support of same are reproduced hereunder as follows:
