Judgement

OMAGE, JCA (Delivering the Lead Judgment): This is an appeal on the ruling of his lordship N.O. Adekola of the High Court in Ibadan, when he sat in the Suit No. I/1245/95. The ruling was delivered on 12/12/95. In the ruling, the now appellant was the defendant/respondent in the suit filed by the now plaintiff/respondent. In the suit, the plaintiff claimed the following four declarations, to wit that the invasion of the office of the National Union of Road Transport Workers Union located at the office of the Akinyele Local Government is unconstitutional, wrongful, illegal, and its entry enforced with force of arms was null and void and of no effect, when with force of arms, the following persons entered the said office of the Road Transport Union. The persons are Oladimeji Ogungbade, Fatai Sumonu, Segun Akingbade, Kasali Lawal, Saliu Owolabi, Tajudeen Iyani and Gbenga Aragbe.
